6IX PICKLE – LIABILITY WAIVER AND RELEASE OF CLAIMS
PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS
In consideration of being allowed to enter, use, and/or participate in any way at 6ix Pickle (“Facility”), including but not limited to playing pickleball, attending events, clinics, or social gatherings, I agree to the following:
ASSUMPTION OF RISK
I understand and acknowledge that participation in pickleball and other activities at 6ix Pickle involves inherent risks, including but not limited to physical injury, falls, collisions with other participants, equipment failure, or facility hazards. I knowingly and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of the released parties defined below.
RELEASE AND WAIVER OF LIABILITY
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless 6ix Pickle, its owners, directors, officers, employees, agents, contractors, affiliates, landlords, and sponsors (“Released Parties”) from any and all liability for injury, disability, death, or loss or damage to person or property, whether arising from negligence or otherwise, to the fullest extent permitted by law.
INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, and expenses (including legal fees) arising out of or in connection with my participation in activities at the Facility.
MEDICAL TREATMENT
In the event of an injury or medical emergency, I authorize the Facility and its staff to seek medical assistance or emergency treatment on my behalf. I accept full responsibility for all medical costs incurred as a result of my participation.
RULES AND CONDUCT
I agree to comply with all Facility rules, instructions, and posted signage. I understand that failure to follow these may result in my removal from the Facility without refund or further liability.
MEDIA RELEASE
I grant permission to 6ix Pickle to use my image, likeness, or voice in any promotional materials, photos, or recordings taken at the Facility.
SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
